View Full Version : Has anyone ever heard of this?

A few weeks after my car accident in April, I received a bill statement for $350 because the Township police responded to the accident and I'm not a resident of the Township. It listed services performed, loading patients into the ambulance and directing traffic, etc. My father helped the ambulance guys and an older gentleman took care of directing traffic. I was annoyed, until I read that the bill had been submitted to my insurance company and most of the time, the company pays it. Fine - I figured it was the insurance company's fight.

Fast forward to this past Monday. I receive a large envelope from a cost recovery service. My insurance company refused to pay the claim, so this bill is my responsibility, or so they say. In the envelope is a letter basically bad mouthing insurance companies, i.e., their collection of insurance payments from customers far surpasses the funds paid out, blah blah blah. Also in the envelope is a copy of the Township Ordinance, indicating that if I don't pay it within 60 days, the Twp. Solicitor will file a suit against me. I just sat and cried - I need this bill right now like a hole in my head - I just got my increased auto insurance (not as bad as I thought, but still).

I fired off an e-mail to my insurance claims person about the bill and asked if their explanation was correct. He called last night and told me that they weren't responsible for that charge and neither was I. His advice? Ignore it. I can't ignore it - it will drive me crazy. Besides, it's not him that the suit will be filed against - it's me. He told me if I get a threatening letter, to call him back and he'll deal with it.

I'm just so upset over this whole thing. I talked to my boss, he's no help. I talked to my dad - he told me to call the recovery service and talk to them. If that doesn't get me anywhere, call the Township and talk to them.

I could understand if it was a bill from the fire department (they weren't called, thank goodness) - they're a volunteer service. I would have shut up and paid the costs. But, the police department is a paid service. I spend money in that township, I shop in their stores, I purchase gasoline there (it's the closest gas station). I can't help the fact that it is a horrible intersection and everytime I go through there, there is fresh set of skid marks in the same place. On the day of my accident, a man came over to me (after the second accident in less than an hour, in the same place, same circumstances, except it was a hit and run) and told me not to cry, there are a lot of accidents there.

If I had only traveled less than a quarter mile down the road and turned right and then had an accident, I would have been in my own township.

I have heard of that before. They do it all the time in WV. To me it is the biggest crock I have ever heard of. Guess what, that is their job! That is what the tax payers pay the township for. You can't just discriminate due to addresses. I say, let them file suit and deal with it then. Quite frankly the cost of filing suit against you and actually taking it to court is going to far outweigh the $350 that they are asking you for. Hell, write to the ACLU and let them know you are being discriminated aganst. A nice, sweet, church going girl, who is trying to just save up the money for her wedding and happily ever after life? They kill for cases like that.

I just love your responses Lacey!!! They are sooooo funny, yet sooooo true!!!! I agree that I would just let them file suit...because more than likely they won't!!! I had a very bad car accident last year-my car was totaled- and I received a similiar bill...but fortunately my insurance covered it!!! Good Luck!!!!

The ACLU...lol. I never thought of it as a discrimination action!

I agree! Companys and so forth always try to scare you w/ that file suit ****, which it will cost them more than what they want you to pay! You could always even get a free consult from a lawyer,he/ she may be able to file suit against them! (or @least tell you what to do in this kind of case, so you feel better.)

I have never heard of such a thing, but then again I have never been in an accident where the police have been called. I don't know if that happens here or not. Lacey seems to have really good advice though.

I would listen to your insurance co. they know the laws and what you are responsible for. I also believe on most insurance plans they would pay for the lawyer to defend you and when you would win (or have the case thrown out of court) the township would also have the pay the ins. co. for their lawyer fee. They would not have advised you to do that if they weren't certain of the law. Just stay in contact with your ins. co. and make them aware of any further developments.

I used to work for an insurance company and they are correct. This is not their responsibility or your responsibility. Your insurance company should offer you a lawyer if this goes to court. I would probably research the township laws. I would also send them a letter stating that your father helped the ambulance guys and an older gentleman took care of directing traffic. I would also state that you do not live in that township and do not see how that fee applies to you. Most of the time they drop these things.

Yeah, that is my brillant husband and his cousin....We got a bill for well over $1000.00 because of all the people it took to get him out of there...we never paid it and they haven't bothered us...I wouldn't worry about it too much, but your insurance company may have better answers as it probably varies state to state.
