View Full Version : We've decided to build a house!

Well we've looked at a million houses, it seems and nothing was right. We'd find a house we like but it would be in a bad neighborhood, or it would have a basement with water damage or there would be problems with the foundation. It was always something! It was soooo frustrating!! We didn't mind the fact that all the houses needed work since FH is a carpenter but we weren't going to invest in property that had major problems.

FH's dad kept telling us we should consider building a house but we didn't think we could afford it. But FH's dad sat down with FH and showed him that we could build a brand new house for about the same price range we were looking in. Since FH, his dad & bro are all carpenters, they pretty much can build the house for the cost of the materials.

So now we've been looking at lots where we can build and....we found the most perfect piece of land ever!!!

It is on a hill overlooking a valley and a creek. The people who own all the land around it have thousands of acres of green rolling hills for their cows. The view out there is beautiful! So after we saw the property we rushed up to the planning & zoning lady's office to find out what it was zoned as. She said "oh you have to have 40 acres in order to build a house on it". There is only 3 acres up for sale so she was pretty much telling us its zoned for agricultural only & there's nothing we can do.

So we were super disappointed and FH was just going to move on. The land is so beautiful and so perfect, there was no way I was going to give up just like that. I told FH that we could try and talk to the county & try to get it rezoned. FH went up to the assessors office and asked if they could find out the zoning because we just wanted to double check that the zoning lady gave us the right information. They said that he'd have to ask the zoning lady...who just happened to be there in that office and she was ticked off that FH was questioning what she already told him. In a very irritated & snotty tone she said, "I ALREADY told you that it is zoned Ag-1. I would have told you if it was Ag-2."

Well after doing some research, I actually think the zoning lady was WRONG! All the public record documents that I could find list the property as Residential. We even pulled a map off the zoning lady's website and on that map it shows that area is NOT zoned Ag-1.

We looked up the owner of the property and FH talked to him this morning and he said that it is zoned Residential and that there is even a well on the property (which if we are able to buy this and build on it...that solves a huge problem! We figured we'd have to wait 2-3 more years to build because we'd need to save up money for the well).

So hopefully we can get enough documentation to show this zoning lady that it is zoned residential...or at least Ag-2. Because if its zoned Ag-2 there's a chance we can build on it. But if its zoned Ag-1, we can't build on it at all unless we get it rezoned but that will cost us hundreds of dollars.

And IF we can prove to her that it is zoned residential...then we are going to put in an offer because if its zoned residential AND has a well...then it is a STEAL!

Oh, I hope everything works out for you. It's always something with land. When we build our house a few years ago, we were delayed over a month because we had to proved that the land wasn't part of a bird sanctuary. And this was after we had purchased the land! Come to find out, the bird sanctuary is like a half mile away but what a pain in the rear :irked:

I'm sooooo excited! FH just went and talked to the zoning lady and she says....her map was WRONG!! She said the map that we got off her website is THE OFFICIAL map of the county.

So we can build on it! FH is taking his dad out there now to look & make sure we could build a drive way (its up on a hill) & to check out the well. Then we'll probably make an offer!

That's so cool and exciting!! We wanted to build originally, but land is sooo expensive here and to take out a loan on it, we would need 20% down! I will live vicariously through you! :)

Have you guys looked at any house plans yet??

We've drawn up some ideas but haven't done much past that yet.

We have some more things to look into before we make an offer. We'll hopefully know more Monday!

So we have several things now standing in our way of our dream property & it's likely that we won't be buying it now.

1. It is going to be rezoned in June to Ag-1. So we would have to get a building permit by the end of this month and the house would have to be done within 6 months. But that won't work because....see #2 & #3.

2. Even if we put in an offer today, we would not be able to close on it and get a building permit for it by the end of this month.

3. We were unable to locate a well on the property. There are no records for a well permit in the last 30 years so if there is a well...its probably no good. So putting in a well would cost us at least $10,000, plus we'd have to put in a septic tank. If we could just buy the land and save up a year or two so we can afford the well & septic then that would be ok, but we can't since they are rezoning it & we only have 6 months to get the house built.

4. The guy with all the cows who owns thousands of surrounding acres has been farming on half the land and on the other half he has his fence on for his cows. So he might be able to fight it and say the land is now his through adverse possession (squatter's rights). Not sure if he would be a jerk like that but you never know.

5. FH's parents don't really like the land. The only properties they've EVER liked were like within a mile of their house. I don't know if its just a coincidence or if they really think we need to be THAT close to them.

So things aren't really working out in our favor. :( FH is calling our realtor to get her thoughts on this. I think FH's plan is to also contact the seller so they are aware that the land is going to be rezoned. They'll never be able to sell it if they rezone it so maybe he can petition it and get it changed. I don't know. But I think I need to give up on the dream of living on a beautiful piece of land, surrounded by meadows and rolling hills and no close neighbors and resign myself to the little lot that we are originally looking at. Its under an acre, has a neighbor that will be really close by (and from what I heard, she likes to complain a lot), not beautiful at all....just a plain, small lot. *sigh* Oh well...I should just be happy that we get to build a house. I just really got my hopes up about this dream property.

I'm sorry things aren't working out! It does sound like a great property, but in all honestly, a little under an acre lot, isn't that small!!

That's true. It could be worse. Although we'd have one neighbor close to us, it's still technically in the country and I could sit on my porch and watch the sunset. So if we end up with that land, it isn't the worst thing. :)

How long do you guys plan on staying in this house for?? I know for FH and I, when we bought our house 1 1/2 months ago, the lot wasn't exactly what we wanted, but for a house that isn't going to be our forever home, we were content with it for the next 5-10 years!

That's a good point as well. If we get the smaller lot, then we plan to build a simple 3 bedroom cape cod style house that we can sell in about 7-10 years (if thats what we want), and hopefully then we can find a nice piece of land that we wouldn't mind living on forever.

If we could have bought the beautiful property that we really wanted, then we would have still built a starter home but definitely would have designed it so that we could build on to it later on down the road so we could have stayed there forever.

Yeah, see, I know its not the "ideal" plan, or what you guys want, but you know, if you guys decide to have kids, maybe you are going to want more room, maybe you will want a subdivision, or not, maybe you will need more rooms, etc.

I'm still jealous...I wish we could have built!

So our realtor contacted the realtor that is selling the property we really wanted. Our realtor told him what we found out about the land and how its going to be rezoned. We asked our realtor to do this because we thought the realtor would want to tell his client and any potential buyers. Well we should have known better than that (this realtor is known to be a shady character). The realtor was rude to our realtor and basically hinted that it wasn't his problem and he wasn't going to say anything. We gave it a few days and then FH called the guy who actually owns the land. FH asked him if his realtor told him what was happening with the land and he hadn't heard a word from his realtor. So this scum bucket was going to not say anything let some unsuspecting buyer come and buy the land with hopes to build on it, and by that time it will probably have been rezoned & they wouldn't have been able to do anything.

So now the land owner knows what is going on and I think he's going to petition the rezoning. Hopefully it works out for him because if they rezone it to ag-1, then the land is worthless to anyone but the farmer who owns the land around it.
