View Full Version : A Question about marriage & filing taxes (fun I know)

So if we were legally married on December 10th 2008 then do we get to mark our taxes as "married" instead of single or is there a certain amount of time you have to be married in order to do that? I tried googling it with no luck. Any help would be great!! Thanks ladies!

You can choose to file married if you like or married filing single. Most of the time you do better when you file married, but this year I believe that my DH and I will do the married filing single because I had a business during part of the year that he didn't have any part of, and we are trying to keep all of our finances seperate.

Nope as long as you were married by 11:59 on December 31, 2008 you can file as married. Or as married filing single but your accountant should be able to guide you to make the right decision for you.

I called the IRS and they said anything that happened before Dec 31st counts as a full year no matter what so since I married dec 18th were filing married

Yeah as long as it is in 2008 it counts :)
But I would caution anyone to file jointly, especially if one of you might owe anything. You still get the same deduction whether you file together or you file "married filing separate". I am still being haunted with tax debt of my ex husband's from when we filed together.

Funny you bring this up. I was thinking about it at work on Monday. And this is what I read.
If you changed your name when you got married, it's important to let the Social Security Administration know by filing a form SS-5. If the name on your tax return does not match the name Social Security has for your Social Security number, any tax refund you have coming will be delayed until the discrepancy is resolved. If you're up against the tax deadline and don't have time to change your name with Social Security, you can file a joint return with your husband using your maiden name (the one that matches your Social Security number) and then straighten things out in time for next year's filing season.

This year I am filing married and joint with my husband just because I am getting some back and he owes. It evens out and we end up paying $49 to IRS and $2 to state.
As previous members stated you can file married jointly or married separately. There are pros and cons in both depending on how much your husband makes.
