SO Today I got into an accident

My mom wanted to go to the asian store to pick up some groceries for dinner. I was driving straight minding my own business and idiot 2! count it 2!! lanes away decides he wants to turn into a shopping center into his right. BUT My car was in the way :eek: :eek: WTF its not totaled but I wish it was! MY POOR BABY!!

With that aside, are they insured? Their insurance better cover that idiot's mistake.

Thanks yes I am ok just a bit shakin but thats about it.

His insurance of course was giving me a hard time filing a claim of course but he was the one who got the ticket for improper lane change.

It sucks though I just got the car 6 months ago :bbcry:

They tend to try to make it sound like it was your fault. He got the ticket, you'll be fine, and hopefully so will your car.

Use the threat of your insurance company suing his to recover damages if they have to pay to have your car repaired. In fact that is exactly what they will do if his company does not cover the damages. And get yourself checked out by a doctor. You may not be experiencing real pain now but in a few days it might be a different story.

I'm so sorry that happened :bbcry:...I am sure that everything will work out and you will get his insurance to fix your car. There are just so many people driving that don't pay attention at all. Well, sweetie, good luck with your car and I'm glad that nobody was injured.

Kvettegirl is right. GO TO A DOCTOR!!! It can take weeks to start hurting - from whiplash, or whatever. If you refuse the insurance's help with that now, you'll be hurting in a month and you'll have to pay for a physical therapist by your self. That would suck

I'm SO SORRY about your car!!!!! That's terrible!!!

Make sure they (the appraisers??) check your steering and your driver's side axle. If the other driver hit your tire, it could have messed up the inside of your steering box - which could result in needing to be replaced - as well as the driver's suspension. I have a Prelude that hit a curb and just cuz of that it needs all new steering and suspension on that side. Hence, the reason it still sits in the pasture.

On a happier note, I'm so glad you're okay!!!

My mother is an insurance adjuster (I will be one soon too), so please go to the doctor. If you wait they will use it against you and try to not cover it.

Also, just hand it over to your insurance company. Do NOT talk to his yourself. Your company will know exactly what to do and will take the burden from you.

I'm glad you are okay! I've been in two accidents and yes, go to a doctor. I still have back problems from the first because of the whiplash. I'm 20 and I feel like I'm 80 sometimes.

What kind of car do you have?

omg, i'm glad your okay!! Unfortunately, they drive that way all the freaking time in the Detroit area.. I think its a good idea to go to the doctors. You just never know. Good luck. :(

Back in late 1999, when I was going to my job (first one actually, I was just a senior in high school), my mom was taking me and we were at a red light waiting so that we could keep on moving along... and BAMF!!! We got rear ended. I didn't feel anything then... but, oh yes but, I threw my neck, back and hips out. I had to go to physical therapy for quite a long time, and to this very day I can't crack my neck or back and my hips will go out and I have to click them back in. So sexy.

Anyhoo..... moral of the story is, at the beginning you won't notice it, but get x-rays because a whole mess can lie beneath. I really should go back to a chiro and a physical therapist, but I just can't afford it right now.

Good luck, go to a doctor, sue them (I sued that lady - she had shady insurance too and I only got 5,000 out of her and I can't go after her again if something happens as a result of the injury which just sucks), and use that money towards your wedding. LOL

Yeah I am feeling the pain today! My whole left side hurts, I was having sharp pains in my butt/backbone area. I am leaving today at 3pm for the doctors. urgh it unbearable when the pain hits.

Be sure and take notes on everthing. When you go to the doctors, pain levels, and always take notes when you talk to the insurance people. That way if you have to take them to court to pay for the stuff you have written proof.

i got into an it like that bout year and half ago and really the police said i made a left and was not allowed cause they said was a double line but truth was after photos were shot and were developed the got in trouble cause there was not a sign of No making a left turn and there was a break in the lines and so i did not make a improper turn but the guy hit me was in a big truck with no lights on while it was pouring and pitch black out so he gets to his insurance and they said it was all my fault yet he got in trouble for speeding and he has up to a year to claim if he has any medical probs which is dumb to give so long but owell it was a fifty fifty accident both us at fault but i still can prove he sped and how dark it was esp with no him and no lights on..hehehe

well just got back from the doctors and he said I had swelling in my back and neck from the accident. I have to go to a chiropractor for medical attention since he is only a general practitioner. He also said I should get an attorney as well because chiropractor is going to cost $$.

I was in an accident several years ago and was referred to a chiropractor too. My health insurance didn't cover it, but my auto insurance did since it was accident related...hopefully you can work something like that out! I had to go to the chiropractor for a whole year - but I also got massages every week for six months as part of my treatment - can't complain about that!

I had to go to the chiropractor for a whole year - but I also got massages every week for six months as part of my treatment - can't complain about that!

yeah it looks like I will be in for 3 months of treatment so far, but the guy that hit me, his insurance is going to cover it. I also hired an attorney to take care of the paperwork. He did also mention to me about my auto insurance could cover it if I have medical on it and whatever the other guys insurance pays me I could keep.

speaking as a Chiropractic assistant who worked with Personal Injury cases for over 8 years let me tell you that sometimes the Insurance will pay you and not the Dr. He will probably have you sign a document called a Medical Lien which entitles him to payment before you.
Lawyers are great don't get me wrong but sometimes they can say things that are not the way things actually happen in real life.

Lawyers are great don't get me wrong but sometimes they can say things that are not the way things actually happen in real life.

They made me sign something not sure what it is called but the allstate is going to send me a check with my name and their name and I am supposed to bring it to them.

Not from the patients point of view. If your lawyer is on the ball he will get the check to the Dr. as soon as he gets it. We had to wait for one for 3 months because He locked his office and went fishing. It was a small office and his secretary was his wife and she went with him. Mid life crisis with him winning a big case mixed in.

Everything should be okay. Usually during treatment reports are sent out to the lawyer and Insurance company. At the end of treatment the Insurance company sends out the checks. Depending on your progress it could take a short time or long. Just don't let anyone bully you to end treatment before the Dr. releases you. He is the expert. I don't care how many personal injury cases your lawyer has had he does not understand the body like the dr. does, and everyone heals differently.

Yeah, when I was in my first accident with a friend, I told the doctor I was feeling fine, when in all reality I just wanted the whole mess to be over and I wanted my check. I was only 16 at the time.

Now knowing what I know now about my pain and being that I am a legal assistant, I wish I would have waited until I had no pain at all. I can only sit without support for my back for 20 minutes and still get shooting pain and numbness in my back.

Also, from the legal perspective, make sure you keep a good shadow file of everything the attorney does. This is for two reasons: 1 - You may decide that he/she is not doing a good job and you are not satisifed with their work. This way, you can go to another attorney and give them all the documents that the previous attorney has already worked on instead of waiting for the previous attorney to get the file to the new attorney (if this makes sense!) and 2 - Your Fee Agreement/Retainer Agreement with your attorney probably says something about how he/she gets a certain percentage of your winnings (typically 1/3 in the State of Wisconsin). Make sure you get every penny that is coming to you. My attorney kept more like 43% for himself and still owed me another $500!

Were you wearing your seatbelt? Because I wasn't and the accident wasn't THAT bad. The second accident I was in was much worse and I had it on and had hardly no pain.

Yes I was wearing my seat belt, funny thing was it was a front end collision but my airbags didnt go off and if you see the pictures he did a lot of damage. I mean it looks like he used a plow truck! LOL

So do you think if you went to the doctors that it would of helped you back heal better?

I talked to the paralegal this morning (she called me) and sounds like they are on the ball.

I went about 4-5 times to the doctor for follow ups and told him I was better (because I was young and stupid, and like I said, I wanted my pain and suffering money!).

Today, I still get muscle spasims and if the pain gets really bad, it eventually goes numb and starts to tingle. I have a heating pad at home and work when that happens. This was all the result of whiplash in my neck.

Your car looks REALLY beat up. Like I said, it takes a lot to total out an Infiniti unfortunately!

awe that sounds very painful!

I started feeling the pain 3 days after the accident. It goes up and down, sometimes it hurts really bad and sometimes its fine. I sit in an office all day and it very painful if I sit for more than 10 minutes at my desk.

I looked up my kbb tradein price and its at $18,500, someone told me I have to 60% meaning $11,000 in damages. :bbeek: I posted it on my g35 forum and they said it looks like $6,000 worth of damages plus I can get them to give me depreciation for my car (well gonna try) lol

Its going to be close but I am going to try and get them to total it out so I can get that G37 :D
