$400,000 dollar lawsuit????? $27,000 dollars for flowers?!!!!! distressing and embarrassing???? LOL Give me a break!
Newlyweds in New York have filed a 400,000 dollar lawsuit against the florist who supplied the flowers for their wedding, saying they were the wrong color and wilted, press reports said Tuesday.
Among things that drew the ire of the bride, Elana Glatt, who also happens to be a lawyer, were the alleged inclusion of cheaper orchids than promised in the bridal bouquet, the New York Times reported.
She also complained about five dollar street vendor-quality roses in arrangements for which the florist charged 55-65 dollars, and dusty vases with no water.
But the most "egregious" of her numerous complaints was the fact that florist Stamos Arakas had substituted pastel pink and green hydrangeas for the rust and green flowers she had chosen for the centerpieces.
"The use of predominantly pastel centerpieces had a significant impact on the look of the room and was entirely inconsistent with the vision the plaintiffs had bargained for," the Times quoted the lawsuit as saying.
Glatt said the flowers were paid for in advance by her mother-in-law and cost more than 27,000 dollars.
In her suit, which outlines numerous "distressing and embarrassing" offenses, she accuses Arakas of "unjust enrichment."
Arakas told the New York Times that Glatt had sent him several emails prior to filing the lawsuit, demanding a 4,000 dollar refund, but he ignored them because "they were so insulting."

While if the florist did screw up everything I would say the MIL who paid for the flowers deserve a refund..But, to sew for that much is insane!!

I guess it depends - I might want to sue if I had paid a lot for the flowers and they were wilted. However I wouldn't sue for that much - she's probably going to lose because of that.

It couldn't hurt .... she's going to know exactly what arguments to use when making the case. Still, I think that the turning this into a $400,000 lawsuit is just a money grab.
Ok so the flowers weren't quite as fresh as she expected but did it ruin her wedding so completely and utterly that she couldn't walk down the aisle or bare to be in the presence of some supposed wilty flowers?
Give me a break LOL Perhaps a partial refund is in order but that's it. I would think that the bad press that she brought against the florist is revenge enough.

She's suing for $400K, but is probably expecting to settle and get less. I do think that if a vendor doesn't deliver on what they promise, they should do their best to fix the problem. She's trying to prove a point -- if they would have given her the $4K refund, she would never have brought the suit. Plus, from other things I've read, the florist substituted much cheaper flowers than what was originally promised. Plus, if they were dying, and the vases were dirty, I'd be prettty upset as well. I do think $400K is a bit much, but I think she's just trying to prove a point -- and maybe make sure that these particular florists don't try to cheat anyone else.

I am all for making sure that you get your money's worth when you buy something but, I am just tired of seeing the courts tied up with frivolous court cases. Seems that too many people see the courts as a way to make an quick buck.
This one reminded me of the guy that wanted a pile of money because the dry cleaner misplaced his pants or the lady that sued because she spilled hot coffee on herself.

400k...That's probably the cost of her whole wedding. Since the flowers "ruined" it, she's probably suing for the cost of her whole wedding.

These are pretty much my thoughts too. If they screwed up then by all means the bride (or whomever paid) deserves a refund; and I would tell everyone I know not to use that company. But I agree that it is frivolous to sue for such a large amount.
I am sure that having the wrong/bad flowers didn't actually ruin their whole wedding, sure it sucks that they didn't get what they paid for, but come on ... this is what gives lawyers a bad name :bbrolleyes:
On a side note; this is a perfect example of why you should get wedding insurance. And as a vendor you should have a limited liability clause in your contract to protect you from such things.

I think you are right..I too would be very very upset, and would expect the refund to be given (if nothing else for the difference in price for the cheaper versus what was promised).
400K is alot yes but It's prob. because she's wabting to make a point and so others know..I bet the florist goes outta business,which is also what she's prob. getting at LOL
